Legal terms and conditions of the Waixo Club program

1. General

Waixo Club is a loyalty program aimed at customers of www.waixo.net, whose objective is to reward recurrence and loyalty through a system of levels and exclusive rewards. Participation in this program is automatic after making the first purchase and is subject to the terms detailed below.

2. Program Levels

The program consists of three levels:

Waixo Friend: automatic entry level upon making a purchase.

Waixo Creator: accessed after placing a minimum of two orders in a calendar year and/or accumulating a spend equal to or greater than €500 in said period.

Waixo Ambassador: exclusive level, accessible only through internal assessment criteria defined by Waixo, based on factors such as purchase frequency, customer seniority, interaction with the brand, and other non-disclosed metrics. There is no direct method to request access to this level.

3. Rewards and Conditions

Points: points accumulated in the program are valid for 12 months from the date they are obtained. After this period, they will expire automatically without the possibility of recovery.
Free shipping: available only for Waixo Ambassador level customers, with a minimum order of 10 meters of fabric. Valid exclusively for shipments within the Peninsula (Spain).
Free meter of fabric: promotion subject to a minimum purchase of 10 meters. Applicable only to specific references and subject to availability.
Other advantages: rewards may include special discounts, priority access to new products, rewarded surveys, or other advantages that will be communicated occasionally.
Personalized promotions: Waixo may send special campaigns, gifts, or personalized benefits to customers who meet certain internal segmentation criteria (RFM, recurrence, brand interaction, etc.). These actions do not generate a right to claim nor are they enforceable.

4. Restrictions

Access to each level is subject to validation, and manual entry to a higher level cannot be requested.
There is no option to unsubscribe from the Waixo Club program as such. However, users may exercise their right to object to the processing of their data in accordance with current data protection regulations.
Program rewards, levels, and benefits are non-transferable, non-exchangeable for cash, and subject to availability.
Waixo reserves the right to temporarily or permanently suspend the participation of any user in the Waixo Club program if it detects fraudulent, unfair use or use contrary to the spirit of the program, including but not limited to:
- Creation of multiple accounts for the purpose of accumulating benefits.
- Manipulation of purchases or returns.
- Any action that involves harm to the brand or its customers.

5. Points and Expiration

Points are obtained automatically for each purchase and can also be generated through special promotions.
Points are valid for 12 months from the date of obtaining.
Once that period has elapsed, the points will expire automatically, without the possibility of recovery or compensation.

6. Program Modifications

Waixo reserves the right to modify at any time:

The conditions for access or stay in the program.
The rewards or benefits offered.
The level and scoring system.

These modifications will be notified via email and/or through the website.

7. Processing of Personal Data

Waixo will process users' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

Purposes:

Management of the Waixo Club program.
Personalization of the user experience.
Sending relevant promotional communications.

8. Limitation of Liability

Waixo will not be responsible for:

Technical failures, interruptions, or errors on the website.
Cancellations, modifications, or delays beyond its control.
Loss of points due to expiration or misuse of the system.

9. Jurisdiction and Applicable Law

These conditions are governed by Spanish legislation.

Any dispute will be resolved before the courts and tribunals of the consumer's domicile.

10. Improper Use of the Program

Waixo reserves the right to temporarily or permanently suspend any user from the Waixo Club program in the event of detection of fraudulent use, manipulation of the points system, improper use of benefits, identity theft, or other behaviors contrary to contractual good faith.

11. Interpretation and Normative Priority

In the event of a discrepancy between these conditions and any other communication (digital or printed) related to the program, these legal conditions shall prevail. Waixo reserves the exclusive right of interpretation of these conditions.

12. Entry into Force and Review of Conditions

These legal conditions enter into force as of 07/01/2025 and will remain in effect until new versions are published to replace them.

Waixo undertakes to communicate any substantial update to registered users of the program, by email or by notice on its official website.

13. Personal and Non-Transferable Nature

The points accumulated, levels achieved, and benefits associated with the Waixo Club program are personal and non-transferable. They may not be assigned, sold, exchanged, or used by third parties other than the account holder.

In the event of a discrepancy between translated versions of these conditions and the original version in Spanish, the latter shall prevail for all legal purposes.

16. Non-Accumulation of Rewards

Promotional rewards from the Waixo Club program will not be cumulative with each other, unless expressly indicated in the corresponding promotion. In case of doubt, the most restrictive interpretation shall prevail.
